The Human Rights and Equal Opportunity Commission has received an application under section 55 of the Disability Discrimination Act from the Australian Railway Association (ARA) on behalf of its members for a temporary exemption, for a period of 5 years, in relation to a number of provisions of the Disability Standards for Accessible Public Transport.

These draft recommendations are being circulated for comment before final recommendations are put to the Human Rights and Equal Opportunity Commission. In view of the amount of discussion which has already occurred on this application a period of four weeks for comments is being provided.

Section 55 of the Disability Discrimination Act 1992 (Cth) gives the Commission the power to grant temporary exemptions from certain provisions of the Act. Temporary exemptions may be granted for up to five years at a time and may be granted subject to specified terms and conditions.
