As you know, the Commonwealth Disability Discrimination Act, and equivalent laws in all States, make it unlawful to discriminate on the ground of a person's disability. One of the areas covered by the Act is access to premises. The only exception to this is where a building is already constructed not providing access, and alteration to provide access would cause unjustifiable hardship.

Today is International Day of People with Disabilities. It is a day for acknowledging those among us whose daily lives include the realities of a disability.

On behalf of the Commission I'm very pleased to receive the C & W Optus Disability Discrimination Action Plan. It's a great way to celebrate this International Day of People with Disabilities.

The electronic mass media are among the most powerful influences on people's lives today. You who work in the media shape our view of the world and of each other. Through media exposure we get access to a vast range of life situations that go far beyond what any one of us could personally experience.

I have to admit that two months ago when I took the title " The Disability Discrimination Act and the continuing battle for equal rights for people with a disability" for my paper today I was not attaching great importance to the precise words of that title.

When I was invited to prepare this paper, Andrew Byrnes encouraged me to concentrate on drawing out strategic thoughts from the Australian experience which might be relevant in Hong Kong , and perhaps in other countries also. That is what I hope to do, rather than spending much time simply reciting that experience or the terms of Australia 's legislation.

I have called this paper "the right to belong", and it is with this idea that I wish to begin my address to you this afternoon, before discussing in more detail the current state of the law in relation to disability discrimination.

I am honoured and delighted to be here to deliver the Kenneth Jenkins Oration. My participation continues the involvement of members of the Human Rights and Equal Opportunity Commission with this event.

I am delighted to have been invited to speak to you tonight on the Eve of International Women's Day, as so many of you are at the eve of being women yourselves, whether international or not. I can tell you, from my own experience, that being a woman kind of creeps up on you: one minute you're a girl, or an adolescent (whatever that may really be), and the next you are a woman!

When I was discussing this event with Jenni Huon we talked about whether the theme should be "transition" or "transitions". At the time I thought it did not matter much, but as soon as I started to write this address I realised that I am going to talk about "transition". The fact that CEOE is conducting this forum in itself indicates that disability is widely seen by business as presenting significant occupational health and safety (OH&S) issues. And certainly, concerns related to occupational health and safety are widely experienced by people with disabilities as barriers to equal opportunity in employment.

This Representative Complaints workshop aims to develop a document on representative complaints to be used by the DDA Legal Advocacy Services, other legal services and other representatives and advocates in making representative complaints and to assist them in if the representative complaints procedure is appropriate in any particular case.

I would like to thank ACROD for inviting me to deliver the Kenneth Jenkins Oration; both because I regard it as a privilege and because it gives me the opportunity to address a gathering of the key people in the disability field at an important time in the work of the Human Rights and Equal Opportunity Commission.
