Social Justice Report 2006: Chapter 2: The new arrangements for Indigenous affairs – facilitating Indigenous access to government services
It has now been over two years since the federal government introduced new arrangements for the administration of Indigenous affairs. One of the catchcries of the new arrangements is that they are aimed at ‘harnessing the mainstream.’ This is to be achieved by removing or reducing the barriers that prevent Indigenous peoples from accessing existing mainstream services on an equitable… -

HREOC submission to Inquiry into Immigration Detention in Australia
Recommendation 1: The Migration Act should be amended so that detention occurs only when necessary. This should be the exception not the norm. It must be for a minimal period, be reasonable and be a proportionate means of achieving at least one of the aims outlined in international law (ExComm Conclusion 44). These limited grounds for detention should be clearly prescribed in the Migration Act. -

In its final recommendations, the Council for Aboriginal Reconciliation proposed that there be a legislative requirement for the Social Justice Commissioner to monitor progress towards reconciliation on an annual basis. In the Social Justice Report 2000 it was noted that while legislative amendment to this end was desirable, this task could be undertaken under my existing functions. Accordingly,… -

The DDA and employment of people with a disability
The standard sort of speech that is often delivered by people in my sort of position at this sort of event is a combination of pep talk and pamphlet, with some bits of a law lecture thrown in: telling people with a disability and their advocates that they have rights under discrimination law, and telling employers that they have responsibilities, and attempting to set out the terms and the effect… -

Chapter 1: The case for addressing workplace discrimination related to pregnancy, parental leave and on return to work after parental leave
In summary Discrimination related to pregnancy and on return to work after parental leave is a systemic and widespread issue that places an economic impost on employers and organisations and on the Australian economy – particularly to the extent that it contributes to women’s under-participation or withdrawal from the workforce. There is a clear business imperative to address such… -

Native Title Report 2002: Recognition of native title
Native title is an intersection of two different legal systems and cultures. Forty eight years ago this Tuesday, on December 10 1948, the United Nations General Assembly adopted the Universal Declaration of Human Rights. The trauma was especially strong among the nations of Europe, particularly because of the Holocaust, but it was also evident in East Asia,… -

Throughout Australia’s history the relationship between the mining industry and Indigenous peoples has been less than harmonious. The drive for resources has seen the rights and interests of Indigenous peoples sacrificed in favour of economic growth. While many problems still remain today, there is evidence of a recent shift in the attitude of mining interests towards neighbouring Indigenous…
