The Human Rights Day Oration was delivered by James Spigelman, Chairman of the ABC and former Chief Justice of the Supreme Court of NSW from 1998 until 2011. His keynote speech tackled the topical issue of ‘Where do we draw the line between hate speech and free speech?’

Conspicuously active in retirement!  Perhaps most notably his Grotius Lecture in London last month in which he raised serious doubts as to the legality under international law of Britain’s invasion of Iraq.  This is hardly the path of a man seeking a quiet retirement.

In keeping with the focus of this agenda item on effective functioning of human rights mechanisms and national institutions I propose at the outset to briefly list some of the key areas with which the Australian Human Rights and Equal Opportunity Commission has been involved over the past year. A more detailed account of those activities will be circulated. So here is an overview:

It would clearly test to destruction the tolerance of the ordinary red-blooded Australian to have a Pom getting off the plane from London and telling them how to run their country. So I shall not presume to say how the current human rights debate in this country should be resolved. The Australian Human Rights Commission supports a Human Rights Act for Australia.  It would set out in a single document the human rights that all people in Australia are entitled to enjoy, and the responsibilities we have to respect the rights of others.
