As many of you know, for over a decade Dr Kidd has been a tenacious and dedicated advocate for the rights of Indigenous people. She has focused especially on the gross inequities that occurred through and under the various 'Protection Acts' that operated in Queensland from the 1890s to the 1980s.

I also want to make mention of the fact that we are 130kn south west of an area of great significance to the Aboriginal communities of western NSW, which is now called Mutawintji National Park - the first park to be handed back to its Traditional Owners under the NSW National Parks and Wildlife Act in 1998. [1] The caves and overhangs in the park have been transformed into expansive galleries of Aboriginal rock art, and it comes as no surprise that they have formed the backdrop for ceremonies for at least 8,000 years.

The title of this session on the conference program is 'The history of human rights in Australian law'. I have chosen to slightly change the topic for a number of reasons. The main reason is because Indigenous peoples' struggle for recognition of their human rights remains to a large extent unfulfilled. Consequently, it is not, and has never been, well reflected in Australian law. Second, because human rights continue to be poorly and rather patchily implemented in our legal system.

I make this acknowledgment in all my public presentations, because recognising the indigenous history of this land is an important element in recognising the truth of our diversity as a people.

Over the past 10 years I have been involved in developing resources and providing informal assistance to organisations developing Action Plans throughout Australia. You would be aware that - according to its own reports - employment of people with disability in the APS has almost halved during the last two decades. You would also be aware of the strong public commitment by the Australian government to reduce the high unemployment and under-employment of Australians with disabilities.

I follow this custom wherever I go to speak in public. I think recognising Australia 's indigenous peoples and their prior ownership of this land in this way is more than just good manners. It is an important part of recognising our diversity as a nation.

I am not here to present South Australia's government as having achieved the last word in access and inclusion for people with disabilities, any more than this report itself seeks to claim that the task is finished.
