Speech by Dr Sev Ozdowski at the United Nations Association of Australia - Tasmanian Branch - Human Rights Seminar: Human Rights from the Perspective of Individual, Collective and Corporate Responsibilities, Saturday 17 November 2001

I'll start with what's stayed the same. The fundamental restructuring of Australia's workplace relations system has left the functions of HREOC untouched. In particular there is no change in its responsibilities to investigate and conciliate complaints of unlawful discrimination.

I acknowledge the traditional owners of the land where we meet today, the Gadigal people of the Eora Nation and I pay my respects to your elders and to the ancestors. On behalf of the Human Rights and Equal Opportunity Commission can I welcome everyone here today and thank you for participating in this launch. Thank you to Rob Welsh, the Chairperson of the Metro Local Aboriginal Land Council for welcoming us all to Gadigal country.

I also want to thank the conference organisers for the opportunity to speak today. conferences such as this are great opportunities to discuss some of the pressing human rights issues in Australia. I'm particularly pleased to be talking about queer rights in the workplace, as fair employment conditions are some of the most fundamental of all human rights. Trade unions have a long history of fighting for justice in the workplace, and I encourage the unions here today to continue that fight for gay, lesbian, transsexual and intersex workers.

To some of you the role of The Human Rights and Equal Opportunity Commission (HREOC) in the industrial relations scene in Australia will be well known, others of you may be wondering why a representative of a human rights body would be speaking on this occasion. I propose therefore to briefly summarise HREOC's role in the administration of federal anti-discrimination law, including its complaint handling function, and to give some recent statistics.

I am speaking on behalf of Dr William Jonas, the Aboriginal and Torres Strait Islander Social Justice Commissioner. Dr Jonas is unable to be here today, with doctors having advised him he is not able to fly at this time due to a recurring illness. Dr Jonas sends his apologies and has asked that I deliver this speech on his behalf. He has asked me to express to you his appreciation for attending today and to thank Parry Agius and Lowitja O'Donoghue for agreeing to speak at this launch.

Let me start by saying that Australia is a culturally diverse society with 23% of Australians being born overseas. Amongst others, there is a sizeable Japanese community and, as you may hear from my accent, I myself was born in Poland.

I would like to thank ACROD for inviting me to deliver the Kenneth Jenkins Oration; both because I regard it as a privilege and because it gives me the opportunity to address a gathering of the key people in the disability field at an important time in the work of the Human Rights and Equal Opportunity Commission.

Human rights are said to be universal and indivisible. This paper explores how far that universality introduces human rights principles into the functions and work of the Administrative Appeals Tribunal (AAT). The answer, I think, could be “further than you realise”.

I also want to make mention of the fact that we are 130kn south west of an area of great significance to the Aboriginal communities of western NSW, which is now called Mutawintji National Park - the first park to be handed back to its Traditional Owners under the NSW National Parks and Wildlife Act in 1998. [1] The caves and overhangs in the park have been transformed into expansive galleries of Aboriginal rock art, and it comes as no surprise that they have formed the backdrop for ceremonies for at least 8,000 years.

Firstly I would like to acknowledge the traditional custodians of the land on which we stand and by so doing remind ourselves that Australia's cultural traditions stretch back many thousands of years and express our aspirations for Australians of the future to be socially just and inclusive.

It is now 12 months since the introduction of WorkChoices radically restructured Australia’s industrial relations system. Today, I propose to reflect on the implications of WorkChoices for the Human Rights and Equal Opportunity Commission (HREOC) and to outline reforms HREOC believes are necessary to safeguard fairness and equality in the workplace.
